EAS 4 July 1939 He was charged with attempted murder of John Dowey, who was staying at the same house in Ruaraka on May 21st. He pulled the trigger but owing to a defect in the mechanism of the gun the cartridge did not explode. He was employed by the Revenue Department as a notice server. The lawyer Dennison referred to this rather peculiar household; in the main building lived Roger's wife, Miss Rogers, a son of Miss Rogers and Mr John Dowey, while Rogers himself lived in a nearby guest house but he ate with the other members of his family. Rogers and Dowie were not on good terms, nor was Rogers on good terms with his wife. Rogers' wife told the court how they had heard Rogers blackguarding them to native boys, how they had protested, and following a quarrel, how Dowie had gone back to some work he was doing in the garden. Then Rogers appeared with a shotgun and pointed it at Daley at a distance of 42 feet and attempted to fire. All that happened was a click because the right hand barrel was defective. Dowey was employed by a Nairobi garage. After Rogers had tried to shoot him he ran away so that Rogers did not have a second chance. Rogers said they wanted him out of the house and they had spent his wealth in the past. Rogers was imprisoned for 3 years with hard labour.
